These Terms of Service govern purchases made through the JÆSMIN36 online store and the use of our website. By placing an order, you agree to these Terms of Service and our applicable policies.
JÆSMIN36 is operated by Jaesmin36 OÜ, a private limited company registered in Estonia.
1. Our Pieces
Every JÆSMIN36 piece is made to order and individually handcrafted in Antwerp, Belgium, using precious metals, natural diamonds, gemstones and pearls.
Each design is produced in a strictly limited edition of 36 pieces.
Where applicable, diamonds and gemstones are accompanied by relevant certification from HRD Antwerp.
Due to the natural characteristics of pearls, diamonds, gemstones and other precious materials, subtle variations in color, shape, texture and appearance may occur. These variations are inherent to natural materials and individual craftsmanship and do not constitute defects.
2. Limited Editions
Each JÆSMIN36 design is produced in a limited edition of 36 pieces.
An edition number is allocated following confirmation of an order. Specific edition numbers cannot be guaranteed, requested, changed or transferred unless expressly agreed by JÆSMIN36.
Once all 36 pieces of a design have been allocated, the edition is considered closed and JÆSMIN36 is under no obligation to reproduce or restock the design.
3. Orders
Placing an order constitutes an offer to purchase a JÆSMIN36 piece.
An order is accepted once payment has been successfully received and JÆSMIN36 has issued an order confirmation.
As every JÆSMIN36 piece is made to order and individually handcrafted in Antwerp, production begins following order confirmation and successful receipt of payment.
We reserve the right to decline or cancel an order where reasonably necessary, including in cases of suspected fraud, payment failure, incorrect pricing or product information, inability to fulfill an order, or circumstances beyond our reasonable control.
If JÆSMIN36 cancels an order after payment has been received, the amount paid will be refunded to the original method of payment.
4. Pricing
Prices are displayed in the currency indicated on the website and may be changed at any time without notice.
The price applicable to an order is the price displayed at the time the order is placed, subject to correction of manifest pricing or technical errors.
Taxes, duties, shipping charges and other applicable costs will be displayed or communicated where possible before completion of the purchase.
5. Payment
Full payment is required when placing an online order unless otherwise expressly agreed by JÆSMIN36 in writing.
Production will commence only once payment has been successfully received.
For certain private client, bespoke or high-value orders, JÆSMIN36 may agree to alternative payment terms in writing.
The client is responsible for any charges imposed by their bank or payment provider, including currency conversion or international transaction fees.
6. Made-to-Order Pieces
Every JÆSMIN36 piece is made to order specifically for the client and individually handcrafted in Antwerp.
Once production has commenced, an order cannot be cancelled, returned or exchanged, except in the case of a defect, an error by JÆSMIN36, or where otherwise required by applicable law.
Engraved, personalized, resized, altered, bespoke or otherwise customized pieces may be subject to additional restrictions on cancellation and return in accordance with applicable law.
Returns, cancellations and refunds are further governed by our Refund & Return Policy.
7. Production & Lead Times
The estimated production lead time for each JÆSMIN36 piece is 6–8 weeks from confirmation of the order and successful receipt of payment.
Each piece is individually handcrafted in Antwerp. The 6–8 week production lead time relates exclusively to the creation of the piece and does not include shipping or delivery time.
Production times are estimates rather than guaranteed completion dates. As each piece relies on specialist craftsmanship and individually sourced precious materials, reasonable variations in production time may occasionally occur.
If a significant delay affects an order, JÆSMIN36 will contact the client.
8. Shipping & Delivery
Shipping and delivery times are separate from the 6–8 week production lead time.
Once a piece has been completed and has passed JÆSMIN36 quality control, the client will be notified regarding shipment.
Orders are shipped to the delivery address provided at checkout. Clients are responsible for providing complete and accurate shipping information.
Fine jewelry shipments may require identification and a signature upon delivery.
JÆSMIN36 is not responsible for delays resulting from incorrect delivery information provided by the client, customs processing, or circumstances outside our reasonable control.
Risk of loss and legal title will transfer in accordance with applicable law and the terms governing the relevant shipment.
9. Duties & Taxes
Applicable VAT, sales taxes, customs duties and import charges depend on the destination of the order.
Where duties and taxes are not collected at checkout, the client may be responsible for payment directly to the relevant authority or carrier before delivery.
JÆSMIN36 is not responsible for delays resulting from customs clearance or a client's failure to pay applicable import charges.
10. Returns, Cancellations & Refunds
Because every JÆSMIN36 piece is made to order, returns, exchanges and cancellations are restricted once production has commenced.
Any cancellation request must be made before production begins and is subject to confirmation by JÆSMIN36.
If a piece arrives damaged, defective or materially different from the order placed, the client should contact JÆSMIN36 as soon as possible so that an appropriate repair, replacement or refund can be arranged.
All returns must be authorized by JÆSMIN36 before shipment.
Approved refunds will be issued to the original method of payment.
Nothing in these Terms excludes or limits rights that cannot legally be excluded under applicable consumer protection law.
11. Authenticity & Certification
Every JÆSMIN36 piece is accompanied by documentation confirming its authenticity and limited-edition status.
Where applicable, diamonds and gemstones are accompanied by relevant certification from HRD Antwerp.
Certificates and accompanying documentation form part of the provenance of the piece and should be retained by the client.
Loss of a certificate or other original documentation does not automatically entitle the owner to replacement documentation.
12. Care, Repairs & Alterations
JÆSMIN36 fine jewelry is handcrafted from precious and naturally occurring materials and requires appropriate care and handling.
Damage resulting from misuse, accidents, improper storage, unauthorized repairs or alterations, ordinary wear and tear, or failure to follow care instructions is not considered a manufacturing defect.
We recommend that all repairs, resizing and alterations be arranged directly through JÆSMIN36. Alteration by an unauthorized third party may affect our ability to provide future servicing of the piece.
13. Product Representation
We make reasonable efforts to represent each JÆSMIN36 piece accurately through photography, film, descriptions and measurements.
Colors, scale and appearance may vary depending on the device or screen used to view the website.
As every piece is individually handcrafted and may incorporate natural pearls, diamonds, gemstones and other precious materials, subtle variations between the piece photographed and the piece received are to be expected and form part of its individual character.
14. Intellectual Property
All content appearing on the JÆSMIN36 website, including the JÆSMIN36 name, trademarks, jewelry designs, photographs, films, text, graphics, logos and other creative material, is owned by or licensed to JÆSMIN36 and is protected by applicable intellectual property laws.
No content may be reproduced, copied, distributed, commercially exploited or otherwise used without prior written permission from JÆSMIN36.
Purchase of a JÆSMIN36 piece does not transfer any intellectual property rights in the design of that piece.
15. Website Use
You agree not to use the website for unlawful, fraudulent or abusive purposes or in any manner that could damage, disable or interfere with the operation or security of the website.
We reserve the right to restrict access to the website where reasonably necessary to protect JÆSMIN36, our clients or our systems.
16. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
To the extent permitted by applicable law, JÆSMIN36 will not be liable for indirect or consequential losses arising from the use of the website or purchase of our products.
17. Privacy
Personal information provided through the website is processed in accordance with our Privacy Policy and applicable data protection law.
18. Changes to These Terms
JÆSMIN36 may update these Terms of Service from time to time.
The Terms applicable to an order are those in effect when the order is placed, unless a change is required by applicable law.
19. Governing Law
These Terms are governed by the laws of Estonia, without prejudice to any mandatory consumer protection rights available to clients under applicable law.
Any disputes will be subject to the competent courts determined in accordance with applicable law.
